1. Acceptance of Terms

By accessing or using the BuildSavanna website, platform, mobile applications, or any associated services (collectively, “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must immediately discontinue use of the Services.

These Terms constitute a legally binding agreement between you (an individual or entity) and BuildSavanna (owned and operated by BuildSavanna Inc. or its affiliates). Your continued use of the Services after any updates to these Terms constitutes your acceptance of those changes. We may modify or replace these Terms at any time, and will post revised versions on our website with a “Last Updated” date. It is your responsibility to review the Terms periodically. Continued use of the Services following any revision indicates your assent to the updated Terms.

2. Description of Services

BuildSavanna is a cloud-based WhatsApp Business Platform that enables organizations to manage customer communications, automate workflows, and analyze performance—all from a single, unified interface. Through our Services, you may:

  • Send and Receive Messages
    Utilize the official WhatsApp Business API (via our 360 Dialog integration) to exchange text, media, and interactive messages securely and at scale.

  • Manage Conversations
    Route chats to agents or teams, view a unified inbox across channels, and collaborate internally with notes and tags to resolve customer inquiries efficiently.

  • Build and Deploy Chatbots
    Leverage our drag-and-drop Chatbot Builder or code-based templates to automate FAQs, lead-qualification flows, appointment reminders, and more—powered by AI/NLP for context-aware responses.

  • Execute Campaigns & Broadcasts
    Create, schedule, and send approved bulk message campaigns with audience segmentation, and track delivery, open, and click-through rates in real time.

  • Integrate Payments & E-Commerce
    Generate in-chat payment links, process transactions via Paynow (EcoCash, OneMoney, InnBucks), and synchronize order updates with your e-commerce store.

  • Access Analytics & Reporting
    Monitor message metrics, agent performance, campaign ROI, and system health through pre-built dashboards or exportable custom reports.

Our Services are delivered on a subscription basis, with additional pay-as-you-go options for message credits, professional services, and premium modules. BuildSavanna may modify, suspend, or discontinue any feature at its sole discretion, subject to these Terms.

3. User Accounts & Responsibilities

To use BuildSavanna’s Services, you must create and maintain a valid user account. Your account and all activity under it are your sole responsibility. You agree to:

  • Provide Accurate Information:
    Supply complete, current, and truthful registration details (company name, contact person, email, phone number). Promptly update any changes to keep your account information accurate.

  • Maintain Account Security:
    Securely store your username, password, API keys, and any authentication tokens. Notify us immediately if you suspect unauthorized access or a security breach. You are responsible for all actions taken under your credentials until you report any compromise.

  • Comply with Usage Policies:
    Use the Services in accordance with WhatsApp’s Business Messaging Policy, local regulations, and these Terms. Do not send spam, unsolicited marketing, or prohibited content (e.g., hate speech, illegal activity).

  • Manage Access & Permissions:
    Assign roles (Admin, Manager, Agent, Client) wisely. Only grant access to trusted individuals, and promptly revoke permissions for users who leave your organization or no longer require access.

  • Protect Confidentiality:
    Keep any non-public technical documentation, API specifications, or product roadmaps you receive confidential. Do not share these materials with third parties without our written consent.

  • Accept Automatic Suspension:
    We reserve the right to suspend or terminate accounts that violate these responsibilities, incur excessive support tickets, or pose security risks—without advance notice and without refund.

Failure to fulfill these obligations may result in account suspension, termination, or liability for any damages arising from misuse.

4. Fees, Billing & Subscription Cancellations

4.1 Fees & Payment Terms

  • All subscription fees, message-credit purchases, and one-time feature charges are billed in advance according to your selected plan (monthly or annual).

  • Accepted payment methods include credit/debit card, bank transfer, and Paynow (EcoCash, OneMoney, InnBucks).

  • By activating a paid plan, you authorize BuildSavanna to charge your chosen payment method for all recurring fees until you cancel.

4.2 Automatic Renewal

  • Subscriptions automatically renew at the end of each billing cycle.

  • You will receive an email reminder 7 days before renewal.

  • Renewal charges are processed on the date corresponding to your original signup date.

4.3 Billing Failures & Suspension

  • If a recurring payment fails (e.g., expired card, insufficient funds), we will retry up to three times over a 5-day window.

  • Continued failure will result in temporary suspension of your account and suspension of message-sending capabilities.

  • You remain responsible for all unpaid amounts; reconnection requires settling outstanding invoices.

4.4 Cancellation Policy

  • You may cancel your subscription at any time via the BuildSavanna dashboard or by emailing billing@buildsavanna.com.

  • Cancellations become effective at the end of your current billing period—you retain access through that date.

  • To avoid unwanted renewal, cancellation must be submitted at least 48 hours before the next scheduled billing date.

4.5 Refunds on Cancellation

  • No partial-period refunds are granted for unused days after cancellation.

  • For details on eligibility and exceptions, please refer to our Refund Policy (Section 5).

By maintaining your subscription, you agree to pay all applicable fees and to abide by these billing and cancellation terms.

5. Limitation of Liability & Governing Law

5.1 Disclaimer of Warranties
BuildSavanna provides its Services “as is” and “as available,” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation, nor do we warrant that results obtained from use of the Services will meet your requirements.

5.2 Limitation of Liability
To the maximum extent permitted by applicable law, in no event will BuildSavanna, its affiliates, officers, directors, employees, or agents be liable for any indirect, special, incidental, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising out of or in connection with these Terms or your use of the Services—even if advised of the possibility of such damages. Our total aggregate liability for all claims related to the Services shall not exceed the total subscription and usage fees you have paid to BuildSavanna in the twelve (12) months immediately preceding the event giving rise to the claim.

5.3 Force Majeure
BuildSavanna will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, labor disputes, governmental actions, network or service provider failures, or shortages of materials.

5.4 Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to them will be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions. Any legal action or proceeding must be brought exclusively in the courts of Harare, Zimbabwe, and you consent to the personal jurisdiction of those courts.

5.5 Severability
If any provision of this section (or the Terms as a whole) is held to be unenforceable under applicable law, that provision will be severed, and the remaining provisions will remain in full force and effect.
