1. Introduction
Welcome to Build Savanna. These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding agreement between you (“User,” “Customer,” “you,” or “your”) and Build Savanna (“Company,” “we,” “us,” or “our”) governing your access to and use of the Build Savanna platform, including our website at https://www.buildsavanna.com, mobile applications, APIs, and all related services (collectively, the “Platform” or “Services”).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR PLATFORM.
By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Definitions
For the purposes of this Agreement:

| Organization | The company or entity that holds the subscription |
| Subscription | Your paid plan providing access to Platform features |
| User | Any individual authorized to access the Platform under your Account |
| Workspace | A segregated environment within an Organization for team collaboration |
3. The Platform
3.1 Description of Services
Build Savanna is a comprehensive Business Operating System providing integrated tools across the following Hubs:

| Operations Hub | Workflow automation, task management, and business processes |
| Projects Hub | Project management, team collaboration, and resource planning |
| Content Hub | Document management, media library, and content organization |
| Collaboration Hub | Team communication, workspaces, and internal messaging |
| Analytics Hub | Business intelligence, dashboards, and reporting |
| CRM Hub | Contact management and relationship tracking |
| DocStudio Hub | Document creation, templates, and electronic signatures |
3.2 AI-Powered Features (Savanna Brain)
The Platform includes AI-powered features that:
- Provide intelligent recommendations and insights
- Automate responses and workflows
- Analyze data patterns
- Generate content suggestions
You acknowledge that AI features are tools to assist decision-making and should not replace professional judgment.
3.3 Third-Party Integrations
The Platform integrates with third-party services including but not limited to:
- Payment Providers: Paynow, Paystack, Flutterwave, Stripe, PayPal
- Communication Services: WhatsApp Business API (via Gupshup), Twilio, SendGrid
- Business Tools: QuickBooks, Xero, Shopify, Salesforce, HubSpot
Use of third-party integrations is subject to those providers’ terms of service.
4. Account Registration and Eligibility
4.1 Eligibility
To use the Platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Services under applicable law
- Provide accurate and complete registration information
4.2 Account Creation
When creating an account, you must provide:
- Valid email address
- Organization name
- Your full name
- Phone number
- Secure password
You may also register using social login providers (Google, Facebook, Microsoft, Apple), subject to their respective terms.
4.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized access
- Implementing appropriate access controls for your Users
We strongly recommend enabling two-factor authentication (2FA) for all accounts.
4.4 Account Verification
We may require verification of:
- Email address (mandatory)
- Phone number (mandatory for social signups)
- Organization identity (for certain features)
- Payment information (for paid subscriptions)
5. Subscriptions and Payments
5.1 Subscription Plans
We offer various subscription tiers with different features, limits, and pricing:

5.2 Billing and Payment
- Billing Cycle: Subscriptions are billed monthly or annually, as selected
- Payment Methods: We accept payments via:
- Mobile Money (EcoCash, OneMoney, InnBucks) – Zimbabwe
- Card payments (Visa, Mastercard)
- Bank transfers (for Enterprise plans)
- PayPal (selected regions)
- Currency: Prices are quoted in USD unless otherwise specified
- Taxes: You are responsible for all applicable taxes
5.3 Payment Processing
Payments are processed through third-party payment providers:
- Zimbabwe: Paynow (mobile money and cards)
- Africa: Paystack, Flutterwave
- International: Stripe, PayPal
You agree to the terms of service of the applicable payment provider.
5.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless:
- You cancel before the renewal date
- We terminate your account
- Payment fails after multiple retry attempts
5.5 Price Changes
We may change subscription prices with at least 30 days’ notice. Price changes take effect at the next billing cycle. Continued use after price changes constitutes acceptance.
5.6 Failed Payments
If payment fails:
- We will notify you and attempt to retry
- You have a 7-day grace period to update payment information
- After the grace period, your account may be downgraded or suspended
- We reserve the right to delete data from suspended accounts after 30 days
5.7 Refund Policy
- Monthly Plans: No refunds for partial months
- Annual Plans: Pro-rata refund within 14 days of purchase if unused
- Consumption Charges: Non-refundable (SMS, WhatsApp, API calls)
- Disputes: Contact support@buildsavanna.com within 30 days
6. Usage-Based Charges
6.1 Communication Charges
Certain features incur usage-based charges:

6.2 AI Credits
AI-powered features may consume credits based on usage. Credit allocation depends on your subscription plan, with additional credits available for purchase.
6.3 Storage
Each plan includes storage allocation. Additional storage can be purchased if needed.
6.4 API Calls
API usage may be subject to rate limits and overage charges depending on your plan.
7. User Responsibilities and Acceptable Use
7.1 General Responsibilities
You agree to:
- Use the Platform only for lawful business purposes
- Comply with all applicable laws and regulations
- Maintain accurate and current account information
- Protect confidential information of your customers
- Obtain necessary consents before collecting or processing personal data
7.2 Prohibited Activities
You must NOT:
Illegal Activities:
- Use the Platform for any illegal purpose
- Violate any applicable laws or regulations
- Facilitate fraud, money laundering, or terrorist financing
- Infringe on intellectual property rights of others
Harmful Content:
- Upload malware, viruses, or malicious code
- Transmit spam, phishing, or unsolicited communications
- Host or distribute illegal content
- Share content that is defamatory, obscene, or harmful
Platform Abuse:
- Attempt to gain unauthorized access to the Platform or other accounts
- Reverse engineer, decompile, or disassemble the Platform
- Circumvent security measures or usage limits
- Use automated tools to scrape or extract data
- Resell or redistribute the Platform without authorization
Communication Abuse:
- Send unsolicited bulk messages (spam)
- Violate WhatsApp Business Policy or carrier regulations
- Spoof sender identities
- Send messages to numbers that have opted out
7.3 Compliance with Communication Laws
When using communication features, you must comply with:
- Anti-Spam Laws: CAN-SPAM Act, PECR, and local equivalents
- Telemarketing Regulations: Do-not-call lists and consent requirements
- WhatsApp Business Policy: Meta’s guidelines for business messaging
- Carrier Requirements: SMS/MMS carrier terms and conditions
7.4 Data Protection Compliance
You are responsible for:
- Obtaining valid consent from your End Customers
- Honoring opt-out requests within 24 hours
- Maintaining appropriate data retention policies
- Complying with POPIA, GDPR, and other applicable data protection laws
8. Customer Data and Intellectual Property
8.1 Ownership of Customer Data
You retain all ownership rights to your Customer Data. We do not claim ownership of any data you upload or create on the Platform.
8.2 License to Customer Data
By using the Platform, you grant us a limited, non-exclusive license to:
- Host, store, and backup your Customer Data
- Process your data to provide the Services
- Display your data to authorized Users
- Use aggregated, anonymized data for analytics and improvements
8.3 Our Intellectual Property
We retain all rights to:
- The Platform and its underlying technology
- Our trademarks, logos, and branding
- Documentation and training materials
- AI models and algorithms
8.4 Feedback
If you provide feedback or suggestions, we may use them without obligation to compensate you.
8.5 Data Portability
You may export your Customer Data at any time through:
- Built-in export features
- API access
- Support-assisted exports
We will provide your data in standard, machine-readable formats.
9. Privacy and Data Protection
9.1 Privacy Policy
Our collection and use of personal information is governed by our Privacy Policy, available at https://www.buildsavanna.com/privacy-policy.
9.2 Data Processing
We process Customer Data as a data processor on your behalf. You remain the data controller for your End Customers’ data.
9.3 Data Security
We implement industry-standard security measures including:
- Encryption in transit and at rest
- Regular security audits
- Access controls and monitoring
- Incident response procedures
9.4 Data Location
Your data may be stored in:
- South Africa (primary)
- European Union (backup)
- Other locations as disclosed in our Privacy Policy
9.5 Subprocessors
We use third-party subprocessors to provide the Services. A list of subprocessors is available upon request.
10. Service Levels and Support
10.1 Availability Target
We strive to maintain Platform availability of:
- Standard Plans: 99.5% uptime
- Enterprise Plans: 99.9% uptime (with SLA)
Uptime excludes scheduled maintenance and factors outside our control.
10.2 Scheduled Maintenance
We perform maintenance during low-usage periods and will provide:
- 48 hours’ notice for standard maintenance
- 7 days’ notice for major updates

11. Third-Party Services
11.1 Integrations
The Platform integrates with third-party services. You acknowledge that:
- Third-party services have their own terms and privacy policies
- We are not responsible for third-party service availability or functionality
- Third-party services may change or discontinue features
- You are responsible for your use of third-party services
11.2 WhatsApp Business API
Use of WhatsApp features is subject to:
- Meta’s WhatsApp Business Terms of Service
- WhatsApp Business Policy
- WhatsApp Commerce Policy (if applicable)
Violations of WhatsApp policies may result in suspension of your WhatsApp integration.
11.3 Payment Provider Terms
Payment processing is subject to the terms of:
- Paynow Terms of Service
- Paystack Terms of Service
- Flutterwave Terms of Service
- Stripe Services Agreement
- PayPal User Agreement
12. Disclaimer of Warranties
12.1 “As Is” Basis
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS
- UNINTERRUPTED OR ERROR-FREE OPERATION
12.2 No Guarantee
We do not guarantee that:
- The Platform will meet your specific requirements
- The Platform will be available at all times
- Results obtained will be accurate or reliable
- Errors or defects will be corrected
- The Platform is free of viruses or harmful components
12.3 Beta Features
Beta or experimental features are provided without warranty and may be modified or discontinued at any time.
13. Limitation of Liability
13.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect Damages: Loss of profits, revenue, data, or business opportunities
- Consequential Damages: Any indirect, incidental, special, or consequential damages
- Third-Party Actions: Actions or omissions of third-party providers
- Force Majeure: Events beyond our reasonable control
13.2 Cap on Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED:
- Paid Customers: The amount you paid us in the 12 months preceding the claim
- Free Users: USD $100
13.3 Exceptions
These limitations do not apply to:
- Our gross negligence or willful misconduct
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law
13.4 Allocation of Risk
The limitations in this section reflect a reasonable allocation of risk and are a fundamental basis of this Agreement.
14. Indemnification
14.1 Your Indemnification
You agree to indemnify, defend, and hold harmless Build Savanna, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Your Customer Data or End Customer relationships
- Your violation of applicable laws
14.2 Our Indemnification
We will defend you against claims that the Platform infringes a third party’s intellectual property rights, provided you:
- Notify us promptly of the claim
- Give us control of the defense
- Cooperate with our defense efforts
15. Term and Termination
15.1 Term
This Agreement begins when you create an account and continues until terminated.
15.2 Termination by You
You may terminate your account at any time by:
- Using the account closure feature in settings
- Contacting support@buildsavanna.com
Termination takes effect at the end of your current billing period.
15.3 Termination by Us
We may terminate or suspend your account:
Immediately, if you:
- Violate these Terms
- Engage in illegal activity
- Fail to pay after the grace period
- Pose a security risk to the Platform
With 30 days’ notice, if:
- We discontinue the Platform
- We undergo a change of control
15.4 Effect of Termination
Upon termination:
- Your access to the Platform will cease
- You remain liable for any outstanding charges
- We will retain your data for 30 days (recovery period)
- After 30 days, your data will be permanently deleted
15.5 Data Export
Before termination, you should export your data. We will provide reasonable assistance for data export upon request.
15.6 Survival
The following sections survive termination: Definitions, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and General Provisions.
16. Dispute Resolution
16.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@buildsavanna.com to attempt informal resolution. We will attempt to resolve disputes within 30 days.
16.2 Governing Law
This Agreement is governed by the laws of Zimbabwe, without regard to conflict of law principles.
16.3 Jurisdiction
Any disputes shall be resolved in the courts of Harare, Zimbabwe, unless otherwise agreed.
16.4 Arbitration Option
For disputes exceeding USD $10,000, either party may elect binding arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA).
16.5 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
17. Changes to Terms
17.1 Modifications
We may modify these Terms at any time. Changes will be effective:
- Material Changes: 30 days after notice via email and Platform notification
- Non-Material Changes: Upon posting to our website
17.2 Acceptance of Changes
Continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to changes, you must stop using the Platform and terminate your account.
17.3 Notification
We will notify you of material changes through:
- Email to your registered address
- Platform notification
- Banner on our website
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any order forms, constitute the entire agreement between you and Build Savanna.
18.2 Severability
If any provision is found unenforceable, the remaining provisions will continue in effect.
18.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
18.4 Assignment
You may not assign this Agreement without our written consent. We may assign our rights to an affiliate or successor.
18.5 Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, war, terrorism, strikes, government actions, or internet outages.
18.6 Notices
Notices to you will be sent to your registered email address. Notices to us should be sent to:

18.7 Independent Contractors
The parties are independent contractors. Nothing creates a partnership, joint venture, or employment relationship.
18.8 Third-Party Beneficiaries
There are no third-party beneficiaries to this Agreement.
18.9 Language
These Terms are written in English. In case of translation conflicts, the English version prevails.
